WAIVER OF LIABILITY AGREEMENT
This Waiver of Liability Agreement is entered into by Andrade's Cleaning Co. ("ACC") and the undersigned Lessee for the rental and use of dumpsters provided by ACC. By signing below, Lessee acknowledges and agrees to the following terms and conditions:
1. LESSEE RESPONSIBILITIES AND LIABILITY
Lessee agrees to be responsible for the proper use, scheduling, and site conditions related to the dumpster throughout the rental period, including but not limited to:
• Coordinating the drop-off location and ensuring that the area is clear and accessible for dumpster placement.
• Acknowledge that ACC is not responsible for any damage to concrete, pavers, driveways, or any other surfaces resulting from the delivery, placement, or pickup of the dumpster.
• Taking necessary protective measures to prevent damage to surfaces, such as placing plywood or other protective barriers before the dumpster is delivered.
• Scheduling the pickup of the dumpster in a timely manner.
• Ensuring the area remains clear for the scheduled pickup to avoid additional fees.
2. LOAD RESTRICTIONS
Lessee agrees to load the dumpster according to the following material and weight restrictions:
• 10-yard dumpster: Maximum weight of 4 tons.
• 20-yard dumpster: Maximum weight of 6 tons.
• 40-yard dumpster: Maximum weight of 7 tons.
3. ACCEPTABLE AND UNACCEPTABLE MATERIALS
• Acceptable materials: Construction and demolition debris, yard waste, recyclable materials.
• Unacceptable materials: Hazardous materials, food waste, liquid waste, toxic substances, pollutants, infectious waste, medical waste, and radioactive materials as defined by federal, state, or local laws.
4. OVERWEIGHT LOAD FEES
If the dumpster exceeds the designated weight limit, an additional charge of $85.00 per ton over the specified limit will be applied.
5. RENTAL PERIOD AND EXTENSION FEES
• The standard rental period is ten (10) days.
• Each additional week beyond this period will incur a charge of $85.00 per week.
6. ADDITIONAL FEES AND CHARGES
• Any request to move the dumpster after placement will result in a relocation fee of $85.00
• If the dumpster is not accessible for pickup upon ACC's arrival, a trip charge may apply.
7. ACKNOWLEDGMENT AND AGREEMENT
By accepting this Agreement, Lessee acknowledges that they have read, understood, and agree to the terms and conditions outlined herein.
